PRIVACY PRACTICES FOR PROTECTED HEALTH INFORMATION
This notice describes how your medical information is secured, how it may be used and disclosed, and how you can access this information. The law requires that licensed healthcare professionals maintain privacy of your health information and that you are provided this notice of legal duties with respect to your health information. Please review it carefully.
The following are the confidentiality and privacy practices of Jennifer Weston Smith, LMT of Sunbreak Yoga + Massage PLLC (hereafter known as “Sunbreak Massage”) with regard to Jennifer's role as a Licensed Massage Therapist through the Washington State Department of Health.
Client Rights. Clients may request, in writing, restrictions on records — limiting the way we use or disclose their medical information for treatment, payment or healthcare operations or limiting access to their information by someone who is involved in their care. If the request is reasonable and legal, we will agree to the request and honor the restriction. Clients may request, in writing, to view or obtain a copy of their records. The client may request that corrections be made if they identify errors or mistakes. Access to records will be made during regular business hours within 30 days of receipt of written request and a fee may be charged for copying and sending requested records. Requested records are sent via standard U.S. Mail unless the client requests them to be sent via express mail (at client’s expense). A client may, at any time, revoke, in writing, permission to use or disclose medical information. If permission is revoked, medical information will no longer be used or disclosed for the reasons covered by the initial written authorization. That said, the client understands that Jennifer and/or Sunbreak Massage is unable to take back any disclosures that were made with permission given prior to a written revocation and that in any event Jennifer and/or Sunbreak Massage is required by law to retain records of the care that was provided.
Use of Records. Client records are used to document client health and related massage session information. All records when not in use are maintained online within a secure, HIPAA-compliant, password-protected website and/or in a locked file secured in the office. Client treatment records may be shared with providers who are involved in patients’ health care.
Disclosure of Records. Client records and information are only released to anyone outside of Sunbreak Massage with written authorization from the client unless compelled or required by federal, state or local laws or regulations (such as court order, subpoena, warrant, summons, discovery request or other lawful process). Client information may be disclosed when necessary to prevent a serious threat to client health and safety or the health and safety of the public or another individual. Any disclosure, however, would only be to someone able to help prevent the threat from materializing. Client medical information may be disclosed for health oversight agency activities if, and only if, required by law. These activities may include audits, investigations, inspections and licensure. Client case information may be discussed with other healthcare providers only with written permission of the client. At no time are client records sent electronically (email or fax) unless specifically requested by the client or if compelled by law.
Changes to this Notice. Sunbreak Massage reserves the right to change the terms of this notice at any time. Sunbreak Massage reserves the right to apply revisions or changes to this notice effective for medical information already on file as well as any information received in the future. SERVICES AND CLASSES (PROGRAM) DISCLAIMER
You only get out what you put in.
Our time together in this massage, self-massage, yoga and/or meditation program {the 'Program'} provides ongoing accountability, massage services, bodywork services, yoga and/or myofascial release/self massage and/or breathwork and/or meditation instruction, all based upon Jennifer Weston Smith’s signature methodology. But, you have to put in the time and do the work to get the results you desire.
In order to get the most out of your sessions with Jennifer, it is essential that you listen to your body, show up on time and prepared for your sessions, and watch/read/listen to any supplemental materials suggested by Jennifer.
What It Isn’t:
This Program is not a “magic bullet” or “quick fix” that will instantly deliver success. Sustainable life change is a LONG-TERM commitment, and while the foundation you lay and the practices you’ll establish during our time together are invaluable, they will (most likely) not result in miraculous dream fulfillment. Think of how long it took you to develop a particular postural or movement pattern, for example, and you will begin to understand how long it can take to resolve any challenges that arose from that pattern (particularly if you continue the pattern outside of our sessions).
Investment:
In order to work together in this Program, you are making a monetary investment in exchange for Jennifer’s time and expertise as it applies to your unique body and situation. If you are dissatisfied with your experience in any way, please bring it to Jennifer’s attention as soon as possible, and she will work with you to ensure that you get the most out of your remaining time in the Program.

Refund Policy:
There are no refunds for this Massage, Bodywork, Self Massage, Yoga, Breathwork and/or Meditation Program or Session due to the customized nature of the work.
Reschedule/Cancellation Policy:
If your schedule changes and you should need to reschedule an appointment, please do so at least 24 hours prior to your scheduled time to avoid being charged for your session. Appointments cancelled, missed or rescheduled less than 24 hours before the scheduled time will be forfeited and charged the full session fee. To reschedule or cancel more than 24 hours ahead, please click the link in your confirmation email and choose another available time.
Disclaimer:
Obviously, Jennifer cannot guarantee or warrant specific results with this or any other Program. Any testimonials or results shared may not be typical for all clients. Results that do happen are entirely up to the actions of the individual client, and the client takes full responsibility for said client's individual goals, actions, expectations, risk and results as they pertain to participation in this Program. Further, the client, the client's heirs, and/or legal representatives forever release, waive, discharge, hold harmless and covenant not to sue Jennifer Weston Smith and/or Sunbreak Yoga + Massage PLLC for any claims relating to any loss or damages, real or perceived, resulting from participation in the Program, be it the result of negligence or any other act.
Time Frame:
Your first session must be booked within 35 days of purchasing your package of sessions with Jennifer, and all subsequent/follow-up sessions should be completed before the printed package expiration date -- unless another arrangement has been agreed upon in writing by both parties (client and Jennifer). After the package expiration date, Jennifer and/or Sunbreak Yoga + Massage PLLC reserve the right to apply the amount you paid toward existing service and package prices in accordance with Washington State law.
